Terms of Service

These Terms of Service (“Terms”) govern your access to and use of gskproperties.ca and related features, forms, and tools (the “Site”), operated by GSK Properties (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years of age and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and current.

No Offer; Listings and Availability

All rental and commercial listings, prices, incentives, availability, square footage, floor plans, images, amenities, and other property information are provided for general informational purposes only, may contain errors or omissions, and are subject to change or withdrawal at any time without notice. Nothing on the Site constitutes an offer, representation, warranty, or a binding commitment to lease. A tenancy is created only by a written lease agreement signed by an authorized representative of GSK Properties. You are responsible for independently verifying all information before relying on it.

AI Chat and Voice Assistant

The Site offers an automated chat and voice assistant. Responses are generated by artificial intelligence, may be inaccurate, incomplete, or out of date, and do not constitute professional, legal, financial, or real-estate advice. The assistant cannot bind GSK Properties to any term, price, or availability. Please verify important information with a member of our team, and do not submit sensitive personal, financial, or health information through the assistant. Voice interactions may be recorded and transcribed as described in our Privacy Policy.

Acceptable Use

You agree not to:

• use the Site for any unlawful, fraudulent, or harmful purpose;
• submit false, misleading, or another person’s information without authorization;
• scrape, harvest, or use automated means to access or collect data from the Site;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Site or its systems;
• reverse engineer, copy, or create derivative works from the Site except as permitted by law; or
• upload malicious code or infringe the rights of others.

Your Submissions

You are responsible for the content you submit through forms, feedback, reviews, or the assistant. You represent that you have the right to submit it, and you grant GSK Properties a non-exclusive, royalty-free, worldwide licence to use, store, and process that content to operate our services and, for non-confidential feedback, to improve them. Do not submit confidential information you do not wish us to use for these purposes.

Intellectual Property

The Site and all content on it — including text, graphics, logos, icons, images, video, and software — are owned by or licensed to GSK Properties and are protected by copyright, trademark, and other laws. Except as expressly permitted, you may not reproduce, distribute, modify, or publicly display any part of the Site without our prior written consent.

Fair Housing

GSK Properties supports equal opportunity in housing and does not unlawfully discriminate on any ground protected by the Alberta Human Rights Act or other applicable law.

Third-Party Services and Links

The Site relies on and links to third-party services (including video, mapping, messaging, analytics, and hosting providers) that we do not control. We are not responsible for their content, availability, or practices, and your use of them may be subject to their own terms.

Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on it is accurate or complete.

Limitation of Liability

To the fullest extent permitted by law, GSK Properties and its owners, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, revenue, profits, or goodwill, arising out of or relating to your use of or inability to use the Site, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Site is limited to one hundred Canadian dollars (CAD $100). Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless GSK Properties and its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your use of the Site, your submissions, or your breach of these Terms or applicable law.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in Alberta for any dispute arising out of or relating to these Terms or the Site.

Changes; Severability; Entire Agreement

We may update these Terms from time to time. Changes take effect when posted on this page, with the “Last updated” date revised accordingly, and your continued use of the Site constitutes acceptance. If any provision is found unenforceable, the remaining provisions remain in full force. These Terms and the Privacy Policy are the entire agreement between you and GSK Properties regarding the Site.
